Hardships are Painful!

Got a hardship but did not complete the hardship affidavit to your servicer when applying for the HAMP (Loan Modification) program? This is a required form and you MUST submit it to the servicer. YOU MUST take on this responsibility to go to the Mortgage Loan servicer and ask for the Loan Modification and you MUST provide all the paperwork they tell you is required. YOU MUST follow up on your request and do your homework on knowing what your options are. Effective - December 09, 2009: The servicer should still compile your file and send you the hardship affidavit along with other documents that require your signature and submission. In Trouble with your Mortgage Payments? Where do I start? Loan Modification option IF that does not work? Short Sale option STEP ONE: Loan Modification Program (better known as HAMP) Home Affordable Modification Program For this option, my recommendation is that you contact your lender and see what they require from you. The first question here: Is your servicer one of the companies that have volunteered to be a part of the program? If not, you are under the old guidelines (at the mercy of the servicer). If your servicer is a part of the program and they follow the suggested guidelines... you will need to qualify for the HAMP program. If you do not qualify for step 1 you can possibly move on to Step 2. STEP TWO: Short Sale (better known as HAFA) Home Affordable Foreclosure Alternative Here are some simple questions that you will need to answer YES to: Are you behind in your mortgage? - What does this mean? Behind in your mortgage means that you are late on your mortgage payment. Late mortgage payment means you have not been able to pay your mortgage payment for over 30-60 days.
Have your and your family experienced a hardship that you are still not out of? - What does this mean? Hardship is a life change event that is a direct reason why you are behind in your mortgage. An example of hardship includes at least one of the following: Loss of job, change in income status (decrease), loss of spouse - via death, separation, divorce. New member to family (baby, adoption, taking care of your parents) etc.
Are you not able to catch up on your mortgage? - What does this mean? If you have no means to catch up your mortgage payments, or if you cannot get a loan modification that is something you can afford, plus the bank is willing to give to you as a permanent loan modification.
Have you contacted your lender to request a loan modification? HAMP - What is this? Loan Modification is when your lender agrees to decrease your mortgage payment in an attempt to help you be able to afford your payments.
Is your property upside down? - What does upside down mean? Upside means that your mortgage owed exceeds what your house is worth. Owe more than market value of your property.
